These Terms of Service (“Terms”) govern your use of the services provided by B. Elise Notary Services LLC (“Company,” “we,” “our,” or “us”), including services accessed through our website, online platforms, by telephone, text message, email, or in person.
By booking, purchasing, accessing, or using our services, you agree to these Terms.
1. Services Provided
B. Elise Notary Services LLC provides professional notary and document-related services, which may include:
General notarization
Mobile notary services
In-office notary services
Remote Online Notarization (RON)
Real estate and loan document signings
Apostille facilitation
Document translation facilitation
I-9 verification services
Vehicle Identification Number (VIN) verification
Remote oath administration for depositions and other authorized proceedings
Marriage solemnization and wedding officiant services
Other document and administrative support services
Certain services may be subject to separate agreements, policies, eligibility requirements, or terms.
2. Notary Services and Legal Advice
B. Elise Notary Services LLC is not a law firm, and our notaries are not acting as attorneys when providing notarial services.
Unless separately licensed and authorized to do so, we do not provide legal advice, draft legal documents, select documents for customers, determine the legal effect of a document, or advise customers regarding which notarial act or certificate they should choose.
Customers are responsible for ensuring that their documents are complete and appropriate for their intended purpose before requesting notarization. Questions regarding the legal effect, preparation, or content of a document should be directed to a qualified attorney or other appropriate professional.
We reserve the right to decline or discontinue a notarization when required or permitted by applicable law, including when satisfactory identification cannot be provided, the signer is not willing or able to communicate their intent, the document or transaction raises concerns regarding fraud or coercion, or the requested act cannot lawfully be performed.
3. Eligibility
You must have the legal authority to enter into these Terms and to request the applicable services.
Certain services may have additional eligibility, identification, technology, document, jurisdictional, or legal requirements.
4. Customer Responsibilities
When using our Services, you agree to:
Provide accurate, current, and complete information.
Provide acceptable identification when required.
Ensure that documents are complete and ready for the requested service.
Provide all necessary parties, witnesses, or other participants unless otherwise arranged.
Use our Services only for lawful purposes.
Provide accurate contact and scheduling information.
Comply with reasonable instructions necessary for us to perform the requested service.
Not use our Services for fraudulent, deceptive, illegal, or unauthorized purposes.
We may decline, suspend, or discontinue a service when these requirements are not met or when we reasonably believe the requested service cannot be lawfully or properly completed.
5. Fees and Payment
Fees will be disclosed at the time of booking, ordering, or engagement when applicable.
Payment may be required before, at the time of, or following completion of the service depending on the service provided and any separate agreement between the parties.
Additional charges may apply for services such as travel, printing, scanning, witnesses, shipping, expedited requests, after-hours appointments, or other requested services when disclosed to the customer.
We reserve the right to modify our prices and fees. Changes will not affect services already confirmed at an agreed-upon price unless the scope of the requested service changes.
6. Appointments, Cancellations, and Refunds
Customers should provide at least 24 hours' notice when canceling or rescheduling an appointment whenever possible.
Cancellation, rescheduling, travel, printing, administrative, or other fees may be nonrefundable once work has begun, resources have been committed, documents have been prepared or printed, travel has commenced, or third-party costs have been incurred.
Refund eligibility may depend on the service purchased and the circumstances of the cancellation.
If B. Elise Notary Services LLC cancels a prepaid service that cannot be rescheduled or completed, amounts paid for the unperformed portion of the service will be refunded, except for nonrefundable third-party costs already incurred on the customer's behalf.
7. Third-Party Services
Some Services may require or involve third-party providers, including payment processors, shipping carriers, translation providers, technology platforms, Remote Online Notarization platforms, government agencies, and other service providers.
We are not responsible for delays, outages, processing times, decisions, errors, or other circumstances outside our reasonable control that are caused by third-party providers or government agencies.
Estimated processing or completion times involving third parties are not guaranteed unless expressly stated otherwise.
8. No Guarantee of Outcome
We will provide our Services with reasonable professional care; however, we cannot guarantee that a document will be accepted by a receiving party, government agency, financial institution, court, recorder, foreign authority, or other organization.
A notarization verifies or certifies certain facts as authorized by law; it does not guarantee the truthfulness, legality, validity, enforceability, or acceptance of the underlying document or transaction.
9. Limitation of Liability
To the maximum extent permitted by applicable law, B. Elise Notary Services LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of our Services.
We are not responsible for losses resulting from circumstances outside our reasonable control, including third-party service interruptions, government processing delays, technology outages, customer-provided errors, incomplete or inaccurate documents, or the rejection of documents by a receiving party.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
10. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless B. Elise Notary Services LLC and its officers, employees, contractors, and agents from claims, damages, liabilities, losses, or expenses arising from your unlawful or improper use of the Services, your violation of these Terms, or inaccurate or fraudulent information or documents provided by you.
11. Privacy
Your use of our Services is subject to our Privacy Policy, which describes how we collect, use, disclose, retain, and safeguard personal information.
Our Privacy Policy also contains information regarding SMS/text messaging privacy and the handling of SMS opt-in and consent information.
12. SMS/Text Messaging Terms
When you provide your mobile telephone number and expressly opt in to receive SMS/text messages from B. Elise Notary Services LLC, you consent to receive text messages related to the purpose for which you provided your consent. Messages may include appointment communications, scheduling updates, responses to inquiries, service-related notifications, and other communications you have requested or authorized.
Message frequency may vary. Message and data rates may apply.
You may opt out of receiving SMS/text messages at any time by replying STOP to a message. After opting out, you may receive a confirmation message indicating that your opt-out request has been processed.

Consent to receive SMS/text messages is not a condition of purchasing goods or services from B. Elise Notary Services LLC.
Mobile carriers are not liable for delayed or undelivered messages.
Your SMS opt-in information and consent will be handled in accordance with our Privacy Policy.
13. Electronic Communications
By communicating with us electronically or using our online Services, you consent to receive service-related electronic communications from us, including communications by email and, when you have provided appropriate consent, SMS/text message.
You agree that electronic notices, disclosures, agreements, and other communications may satisfy legal requirements that such communications be in writing to the extent permitted by applicable law.
14. Intellectual Property
Unless otherwise stated, the content appearing on our website and within our proprietary materials, including text, graphics, branding, educational materials, forms, and other original content, is owned by or licensed to B. Elise Notary Services LLC and is protected by applicable intellectual property laws.
You may not reproduce, distribute, sell, modify, or commercially exploit our proprietary content without prior written authorization.
15. Third-Party Links
Our website or Services may contain links to third-party websites or platforms. We do not control and are not responsible for the content, availability, security, terms, or privacy practices of third-party websites or services.
16. Termination or Refusal of Service
We reserve the right to refuse, suspend, or terminate access to our Services when reasonably necessary, including for suspected fraud, unlawful activity, abusive or threatening behavior, failure to pay applicable fees, violation of these Terms, or circumstances in which providing the requested service would violate applicable law or professional obligations.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
18. Dispute Resolution
Any dispute arising out of or relating to these Terms or our Services shall be handled in accordance with applicable law.
If B. Elise Notary Services LLC elects to require binding arbitration or another alternative dispute-resolution procedure, the applicable arbitration or dispute-resolution terms should be separately disclosed and reviewed for compliance with applicable law.
19. Changes to These Terms
We may update these Terms periodically to reflect changes to our Services, business practices, technology, or legal requirements.
The revised Terms will be posted with an updated “Last Updated” date. Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
20. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
To the extent permitted by law, an invalid or unenforceable provision may be modified to the minimum extent necessary to make it valid and enforceable.
21. Waiver
Failure by B. Elise Notary Services LLC to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
22. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights or obligations as permitted by applicable law.
23. Entire Agreement
These Terms, together with our Privacy Policy and any service-specific agreement or policy applicable to your purchase or appointment, constitute the agreement between you and B. Elise Notary Services LLC concerning the applicable Services.
If a separately executed service agreement contains terms that conflict with these Terms, the separately executed agreement will control with respect to the specific service covered by that agreement.
24. Feedback
We welcome feedback, comments, and suggestions regarding our Services.
By voluntarily providing feedback, you grant B. Elise Notary Services LLC permission to use that feedback for legitimate business purposes, including improving our Services, without an obligation to compensate you.
We will not publicly identify you in connection with your feedback without permission unless otherwise permitted or required by law.
